1. Who these terms are with
This website is operated by Creative Form Development, LLC, a New York limited liability company trading as CFD, of 447 Broadway, 2nd Flr, Ste 114, New York, NY 10013. By using the site you accept these terms. If you do not accept them, please do not use it.
2. What this website is
This site describes CFD’s construction management services and the projects we have worked on. It is general information. It is not an offer to contract, a bid, a price quotation, professional advice, or a representation that we are licensed or available to perform any particular scope of work. Nothing on this site forms a contract between us. CFD performs work only under a signed written agreement.
3. No online sales, payments or accounts
We do not sell anything through this website. There is no cart, no checkout, no subscription and no online payment of any kind. We do not collect payment card details here, and we never request them by email. You cannot create an account on this site.
4. Refunds and cancellations
Because nothing can be bought or paid for on this website, there is no online purchase to cancel and nothing for us to refund through it. Fees, invoicing, change orders, suspension, termination, and any refund or credit for services CFD performs are governed entirely by the signed contract for that project.
If you are ever asked to pay CFD through this website, do not pay. Call us on 212 561 3720 or email info@creative-form.com, because the request did not come from us.
5. Enquiries you send us
When you use the contact form you confirm that what you send is accurate and that you are entitled to send it. Please do not send confidential drawings, bid documents or anyone else’s personal information through the form. Sending an enquiry does not create a client relationship, and it does not oblige us to reply, to quote, or to take on the work. What you send is handled under our Privacy Policy.
6. Project information and images
Project descriptions, values, dates, roles and photographs on this site describe work CFD has performed or supported, usually as part of a wider team and under contract to an owner, agency or construction manager. Naming a project or showing its image does not imply that the owner, agency, architect or anyone else endorses CFD. Some images are architectural renderings rather than photographs of completed work; where we know that, we say so in the image description.
7. Client names, logos and press coverage
The names, logos and marks of our clients and partners, and of the publications that have written about us, remain the property of their owners. They appear here to identify real projects and real coverage. They do not indicate any affiliation, sponsorship or endorsement beyond the work described.
8. Our content
Apart from third-party material, the content of this website belongs to CFD. You may read it, print it and link to it. You may not republish it, sell it, use it commercially, or copy substantial parts of it into your own materials without our written permission.
9. Acceptable use
Do not use this site for any unlawful purpose, attempt to gain unauthorized access to it, scrape, overload or disrupt it, or submit anything through our form that is unlawful, abusive or contains malicious code.
10. Links to other websites
Links to other websites are provided for convenience. We do not control them and we are not responsible for their content, accuracy or practices.
11. Availability and accuracy
We take care to keep this site accurate and available, but we do not guarantee either. To the fullest extent the law allows, the site is provided “as is” and “as available”, without warranties of any kind, including implied warranties of merchantability, fitness for a particular purpose and non-infringement.
12. Limitation of liability
To the fullest extent permitted by law, CFD is not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, arising out of your use of this website. Nothing here limits liability that cannot lawfully be limited. These limits apply to your use of the website only; they do not vary the terms of any project contract.
13. Accessibility
We aim to meet WCAG 2.2 Level AA. If any part of this site is a barrier to you, tell us at info@creative-form.com or 212 561 3720 and we will fix it and give you the information another way in the meantime.
14. Governing law
These terms are governed by the laws of the State of New York, without regard to its conflict-of-laws rules. The state and federal courts sitting in New York County, New York have exclusive jurisdiction over any dispute about this website.
15. Changes
We may change these terms. The version on this page, with the effective date at the top, is always the current one.
